The trip price specified in your program is per person, and does not include international air fare.

Payment of the program deposit constitutes your acceptance of these terms and conditions.

COSTS INCLUDE: All in-country ground, air, and waterway transportation; accommodations as specified on itinerary; excursions and activities as specified on itinerary; meals as specified; baggage handling fees; permits and entrance fees; local guides; pre-departure materials, and personalized services.

NOT INCLUDED: Airport departure taxes; passport and visa fees; excess baggage charges; laundry; telephone calls or other personal items; most alcoholic beverages; meals not specified in the itinerary; gratuities; taxis to non-scheduled locations; medical, hospital or evacuation costs. (Travel insurance is strongly recommended.)

ITINERARY: We make every effort to maintain the itinerary; however, it is subject to change depending on weather, festivities, the serendipitous and the unexpected. Your program is designed with the flexibility to take advantage of unforeseen propitious events. Travelers need to have a sense of adventure and be willing to be flexible.

MEALS: Many foods in our destinations will be familiar to North Americans and Europeans, and include many additional — and amazing — flavors! Please inform your guide of special dietary requirements at your first meeting; she will do his/her best to arrange for other meals.

SINGLE | TRIPLE ROOMS: A limited number of single rooms are available at a supplement cost for each trip. Triple room accommodations are available on a limited basis, sometimes at a reduced price. Triple rooms usually consist of a twin-bedded room with an additional folding bed or cot for the third person. They may not be comfortable for three adults.

CHANGES: Due to unforeseen circumstances, iCare Travel may need to make adjustments to your travel itinerary that could alter the final price or design of your trip. While we make all of your arrangements in good faith, unforeseen circumstances may make it necessary to change hotels, transportation or activity arrangements. We reserve the right to make itinerary and price changes as deemed necessary. As none of the accommodation and transportation providers is owned by iCare Travel, we cannot be held responsible for such circumstances and will pass any additional cost or savings on to the traveler.

Concerning iCare Special Departures: iCare Travel may decline to accept or retain any person on an iCare Special Departure at any time. Should a passenger’s conduct become incompatible with the smooth operation of the program or adversely affect the safety and enjoyment of the other travelers, then the program will be withdrawn from the individual and iCare Travel shall be under no liability to such person.

Smoking: The majority of our group travelers are nonsmokers. We require no smoking in our transportation and request no smoking at meals.

HEALTH: Health insurance is required. Medical facilities are neither superior quality nor widespread. We recommend that you see a healthcare provider who specializes in travel medicine. The doctor or healthcare provider will determine what vaccinations and medication you will need, depending on factors such as your health and immunization history, areas of the country you will be visiting, and planned activities. PASSPORTS & VISAS: Many countries require a valid passport for Americans issued by the traveler’s country of residence. Furthermore, at times passports must be valid for a specified number of months beyond intended return date. The traveler must also hold proof of return, or onward journey. The entrance permits for foreigners are valid for period of up to 90 days without a visa. Citizens of other nationalities should check with respective authorities before departure. Some nationalities may be required to obtain a visa.

You are responsible for ensuring that all necessary vaccinations and visas are obtained.

AIR TRANSPORTATION

INTERNATIONAL: iCare Travel does not book airfare to and from the travel destination. Once the traveler confirms the travel itinerary, he/she is responsible to ensure correct arrival and departure dates/times. When booking your airfare to and from the destination, we suggest booking changeable or refundable tickets in case of unforeseen changes in the itinerary.

INTERNAL: Your air transport is a contract made with the airline through the ticketing agent, independent of iCare Travel. iCare Travel works with various agents to secure the lowest fares available. Final fares are negotiated at the time of booking to get the best possible fare. In some cases, the airlines may demand immediate payment at the time of booking to hold seats on air passes. iCare Travel or its agents will inform you about this when the situation arises. Often least cost bookings require immediate payment, in full, and are non-refundable. Air transportation is in economy class on scheduled airlines unless otherwise requested. Requests for specific airlines and/or seats are accepted as preferences only and cannot be guaranteed. All airline seat assignments and frequent flyer programs are under the control of the respective airlines.

A fee may be assessed for changes in internal air travel bookings after tickets have been issued, if change is allowed by carrier, in accordance with the airline’s and issuer’s change and cancellation policies, and depending on the booking class of the ticket. Fee assessments and changes are the responsibility of the ticketing agent and airlines.

Air transportation can be affected by weather, schedule delays or cancellation. These occurrences can affect the design of your itinerary (see CHANGES above). To protect yourself against unforeseen circumstances, please purchase travel insurance.

BAGGAGE: Weight and size restrictions apply on internal flights. Travelers bring baggage and personal effects at their own risk. Check with the airline for other baggage restrictions applicable to international flights. iCare Travel is not responsible for costs incurred due to excess baggage. The transportation providers are responsible for the handling (damage or loss) of your baggage.

Contractual Terms and Obligations

LIMITS OF LIABILITY: iCare Travel, its employees, agents and assigns, does not own or operate any entity that is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, iCare Travel is not liable for any negligent or willful act of any such person or entity or of any third person. In addition and without limitation, iCare Travel is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

RISKS: There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, hiking, walking safaris, climbing injuries and altitude sickness, and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. The traveler assumes all such risks with regard to these possibilities and is hereby given notice that hospital and/or health facilities/personnel for treatment of serious medical problems are often unavailable, and further that evacuation, if available, can be prolonged, difficult, and expensive. We assume no liability regarding provision of medical care or evacuation services and hereby provide notice that any of our staff or subcontractors who may provide emergency medical care in the field may not have had formal medical or first-aid training and would be acting only as a “good Samaritan.”

Protection for your travel investment: Please be aware that Sellers of Travel in the state of California are required to become members of the Traveler Consumer Restitution Corporation. This membership insures the travel investment of California residents in the case of a member travel company’s financial insolvency.

TRAVEL ADVISORIES | WARNINGS: It is the responsibility of the traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department’s travel website at www.travel.state.gov/ or by phone at 1-888-407- 4747. In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should the traveler still choose to travel, notwithstanding any travel advisory or warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

ARBITRATION AGREEMENT: A binding contract shall exist only after iCare Travel has accepted the offer by sending a confirmation to the passenger, either in printed or electronic form.

Should a service supplier not deliver to the traveler’s expectations, iCare Travel and the service supplier must be notified immediately as to allow the opportunity to remedy the situation. Should the situation not change to the traveler’s satisfaction, iCare Travel must receive notification of the dispute in writing (via email or fax) within 24 hours. Transportation companies, airlines, etc., are not to be held responsible for any act, omission or event during the time passengers are not on board planes, transportation or
conveyances.

Any controversy or claim arising out of or relating in any way to these Contractual Terms & Obligations, or any information relating in any way to the trip, or to the trip itself, shall be settled solely and exclusively by binding arbitration in Marin County, CA, USA in accordance with the rules of the Arbitration Association then existent.

TRAVELER’S REPRESENTATIONS: The traveler represents that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to him or herself or other members of the tour. Our travel company partners reserve the right to decline to accept anyone on a trip. Our travel company partners reserve the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise affect the enjoyment of other passengers on the trip.

PHOTOGRAPHY DURING TRAVEL: iCare reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a program with iCare, program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are asked to identify themselves to iCare prior to final payment and he or she will be exempted from this photography waiver clause.

TRAVEL INSURANCE: We highly recommend travel insurance. Between missed connections, unexpected cancellations, lost or delayed luggage, or medical emergencies, you want the peace of mind that your vacation investment is well protected. We recommend Travel Guard for your needs. No matter who you buy from – please consider travel insurance for your vacation.

Note: Personal effects (clothes, camera, etc) are normally covered on your renter’s or home insurance, and will not be covered by trip or flight insurance. Be sure to verify details of your coverage.
